1. Who Can Use This Site

This site is intended for users aged 13 and over. By using the site you confirm that you are at least 13 years old. We do not knowingly collect information from children under 13.

2. The Splat Game — Acceptable Use

The Splat Game lets you upload a photo and direct an animated bird to drop poop on it. It is intended for personal entertainment and light-hearted satire. You are responsible for any photo you upload.

You agree that you will not:

• Upload photos of minors.
• Upload photos of any person without their knowledge or consent.
• Use output from the tool to harass, defame, or intimidate any specific individual or group.
• Upload content that is obscene, unlawful, or infringes a third party's rights.

3. Your Photos Stay on Your Device

Photos you upload are processed entirely in your browser. They are never transmitted to our servers, stored by us, or seen by us. We have no access to the images you upload or the output you create. All processing happens locally on your device and is discarded when you leave the page.

4. Ownership of Your Output

Images you create using the Splat Game are yours. We claim no ownership over your output.

However, output images carry a small poopborne.com watermark. You may share your output freely, but you may not remove or obscure the watermark in a way that misrepresents the origin of the image, and you may not use the watermark to imply endorsement by Eat Flaming Death Studios of any person, product, or message.

5. Our Content

All game assets, artwork, text, logos, and other content on this site are owned by Eat Flaming Death Studios or its licensors and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission, except as permitted by applicable law (e.g. fair use for news reporting or commentary).

6. Disclaimer of Warranties

The site and all content are provided “as is” without warranty of any kind. We make no guarantees that the site will be available, error-free, or free of viruses. We are not liable for any damages arising from your use of the site, including any content you create with the Splat Game and subsequently share.

7. Limitation of Liability

To the fullest extent permitted by law, Eat Flaming Death Studios shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of this site — including any damages resulting from content you upload, create, or share using the Splat Game.

8. Changes to the Service

We may modify, suspend, or discontinue any part of the site at any time without notice. We may also update these Terms of Use. Continued use of the site after an update constitutes acceptance of the revised terms. The date at the top of this page indicates when the terms were last changed.

9. Governing Law

These terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of California.
